OVERVIEW

Welcome to FlexStyle. The terms “we,” “us,” and “our” refer to FlexStyle, operated by Miguel Fernandez Pellicer.

FlexStyle operates this online store and website, including all related information, content, features, tools, products, and services offered to you, the customer (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use our Services.

Please read these Terms carefully. They contain important information regarding your legal rights, including provisions relating to warranties, disclaimers, limitations of liability, purchases, returns, and use of the Services.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with these Terms or our Privacy Policy, you should not access or use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you have given your consent to allow any minor dependents under your supervision to use the Services.

To use certain Services, including purchasing products from our online store, you may be required to provide information such as your email address, billing information, payment information, telephone number, and shipping address.

You represent and warrant that all information you provide is current, accurate, and complete and that you have the necessary rights to provide such information.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account.

However, colors, textures, proportions, packaging, and other aspects of products may appear differently depending on your device, screen settings, lighting, manufacturer updates, or other factors.

Product measurements and sizing information are provided as a general guide. Measurements may vary slightly between products, manufacturers, styles, or production batches.

We do not guarantee that the appearance of a product on your device will precisely match the physical product.

All product descriptions, availability, prices, images, and other product information may be changed at any time without notice.

We reserve the right to discontinue products or limit quantities available for purchase at any time.

Certain products may be available exclusively online and may have limited quantities.

Returns and refunds are subject to our Return and Refund Policy.

SECTION 3 — ORDERS

When you place an order through FlexStyle, you are making an offer to purchase the selected products.

We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including in cases involving suspected fraud, pricing errors, inventory problems, payment issues, shipping restrictions, or other circumstances affecting our ability to fulfill the order.

Payment must be successfully authorized and processed before an order can proceed to fulfillment.

Please review your order carefully before completing your purchase.

If you need to cancel or modify an order, contact us as soon as possible. We will make reasonable efforts to accommodate your request; however, once an order has entered processing or fulfillment, we cannot guarantee that it can be modified or canceled.

If an order has already shipped, our applicable Return and Refund Policy will apply.

If we cancel or materially modify an order, we will make reasonable efforts to contact you using the email address, telephone number, billing information, or other contact information provided with the order.

Purchases are intended for personal or household use unless otherwise expressly authorized by FlexStyle.

SECTION 4 — PRICES, PAYMENTS AND BILLING

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged for a product will generally be the price displayed at checkout when the order is placed, subject to correction of errors where permitted by applicable law.

Unless expressly stated otherwise, displayed product prices do not include applicable sales taxes or shipping charges. Any applicable charges will be displayed during checkout.

You agree to provide current, complete, and accurate purchase, billing, payment, contact, and shipping information.

You represent and warrant that you are authorized to use the payment method submitted for your purchase.

By submitting an order, you authorize the applicable payment provider to charge the total amount displayed at checkout, including applicable taxes, shipping charges, and other disclosed charges.

We may offer promotional codes, discounts, or special offers from time to time. Such promotions may be subject to additional terms, expiration dates, exclusions, minimum purchase requirements, or other restrictions.

SECTION 5 — SHIPPING AND DELIVERY

FlexStyle currently ships within the United States to eligible destinations.

Orders are typically processed within 1–3 business days, Monday through Friday, excluding holidays.

Standard delivery is generally estimated at 5–11 business days after processing, although actual delivery times may vary depending on the product, fulfillment location, carrier, destination, weather, holidays, and circumstances outside our reasonable control.

Certain products may be fulfilled from different locations. As a result, products within the same order may arrive in separate packages and at different times.

You may receive separate tracking information for separate shipments.

Fragrances may contain alcohol and may be subject to carrier restrictions applicable to hazardous or flammable materials. As a result, fragrance orders may be limited to eligible domestic ground transportation and may require additional transit time.

All shipping and delivery dates are estimates and are not guaranteed.

Please refer to our Shipping Policy for additional information regarding processing, shipping, tracking, delays, damaged shipments, and delivery.

SECTION 6 — RETURNS, REFUNDS AND CANCELLATIONS

Eligible products may be returned in accordance with our Return and Refund Policy.

Unless otherwise specified, eligible items may be returned within 14 days of delivery, subject to the conditions stated in our Return and Refund Policy.

Clothing must generally be unused, unworn, unwashed, unaltered, and returned with applicable original tags and packaging to qualify for a standard return.

For hygiene, safety, and product-integrity reasons, opened, sprayed, used, or unsealed fragrances are not eligible for standard returns.

This restriction does not prevent customers from contacting us regarding products that arrive damaged, defective, leaking, or incorrect.

Items clearly identified as Final Sale at the time of purchase are not eligible for standard returns unless otherwise required by applicable law or the product arrives damaged, defective, or incorrect.

Do not return a product without first contacting FlexStyle and receiving applicable return instructions.

Approved refunds are issued to the original payment method in accordance with our Return and Refund Policy.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their content, including applicable trademarks, branding, logos, text, graphics, website design, photographs, videos, audio, and other materials, are owned by FlexStyle, our licensors, suppliers, Shopify, or other applicable rights holders and may be protected by United States and international intellectual property laws.

These Terms permit you to use the Services for lawful personal and non-commercial purposes.

Except as permitted by applicable law, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell, or transmit protected materials from the Services without authorization from the applicable rights holder.

Nothing in these Terms grants you ownership of or a license to any trademark, copyright, patent, or other intellectual property except as expressly stated.

Shopify's names, trademarks, logos, product names, service names, designs, and slogans remain the property of Shopify or their respective rights holders.

All third-party trademarks remain the property of their respective owners.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment services, fulfillment providers, shipping providers, social media integrations, or other services operated by third parties.

We may not control or monitor these third-party services.

Access to third-party tools may be provided “as is” and “as available,” subject to applicable law and the terms and policies of the relevant third party.

Your use of third-party tools or services may also be subject to separate terms and privacy policies established by those providers.

You should review the applicable terms and policies before using third-party services.

The Services may contain links to websites, services, applications, or content operated by third parties.

We are not responsible for examining or evaluating all third-party content, products, services, policies, or practices.

If you access a third-party website or service, you do so subject to the terms and policies applicable to that third party.

Complaints, claims, concerns, or questions regarding third-party products or services should generally be directed to the applicable third party when appropriate.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

FlexStyle is powered by Shopify, which enables us to provide the Services.

However, purchases made through the FlexStyle store are transactions directly between you and FlexStyle.

To the extent permitted by applicable law, Shopify is not responsible for the products sold by FlexStyle or for the sales transaction between you and FlexStyle.

Your use of certain Shopify-powered functionality may also be subject to Shopify's applicable terms and privacy practices.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable law.

Because the Services are hosted or powered by Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services in order to provide and improve Shopify-powered functionality.

Information submitted through the Services may also be processed by service providers that assist us with functions such as payment processing, fulfillment, shipping, analytics, customer communications, fraud prevention, and store operations.

If you voluntarily submit product reviews, photographs, comments, suggestions, ideas, feedback, or other content to FlexStyle, you represent that you have the rights necessary to provide that content.

You agree that we may use submitted feedback or reviews for legitimate business purposes, including operating, improving, evaluating, and promoting our Services, subject to applicable law.

You may not submit content that is unlawful, defamatory, abusive, fraudulent, obscene, infringing, misleading, or otherwise violates the rights of another person.

We reserve the right, but not the obligation, to moderate or remove content that violates these Terms or applicable law.

SECTION 13 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, inventory, or product availability.

We reserve the right to correct errors, inaccuracies, or omissions and to update information when reasonably necessary.

Where permitted by applicable law, we may cancel an order affected by a material pricing, inventory, or product-information error and issue an appropriate refund for amounts paid for the canceled portion of the order.

You may access and use the Services only for lawful purposes.

You may not use the Services to:

  • Violate applicable federal, state, local, or international laws or regulations.
  • Infringe intellectual property or other rights belonging to FlexStyle or another party.

  • Engage in phishing, fraud, impersonation, spam, or deceptive practices.
  • Interfere with the security, integrity, availability, or proper operation of the Services.
  • Collect or track personal information about others unlawfully.
  • Circumvent technical, security, access-control, anti-fraud, or authentication measures.
  • Use automated systems in a manner prohibited by applicable law or applicable technical restrictions.

We reserve the right to restrict or terminate access to the Services when we reasonably determine that these Terms have been materially violated.

SECTION 15 — TERMINATION

We may suspend or terminate access to all or part of the Services when reasonably necessary, including for violations of these Terms, suspected fraud, abuse, security risks, or unlawful activity.

Termination does not eliminate obligations or liabilities that arose before termination.

Provisions that by their nature should survive termination will continue to apply.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

PRODUCT DESCRIPTIONS, SIZING INFORMATION, PHOTOGRAPHS, DELIVERY ESTIMATES, AND OTHER INFORMATION ARE PROVIDED IN GOOD FAITH, BUT MINOR VARIATIONS MAY OCCUR.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 17 — LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLEXSTYLE, ITS OPERATOR, SERVICE PROVIDERS, CONTRACTORS, SUPPLIERS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, SAVINGS, DATA, OR OTHER INTANGIBLE LOSSES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless FlexStyle, its operator, affiliates, service providers, contractors, licensors, and applicable partners from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your material violation of these Terms, applicable law, or the rights of another party.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law.

The unenforceable portion will be considered severed from these Terms without affecting the validity and enforceability of the remaining provisions.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and rules referenced or posted through the Services, constitute the agreement between you and FlexStyle regarding your use of the Services, subject to applicable law.

SECTION 21 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations as part of a business reorganization, sale, transfer, or other lawful business transaction, subject to applicable law.

SECTION 22 — GOVERNING LAW

These Terms of Service and your use of the Services will be governed by the applicable laws of the State of Florida and the United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Any dispute subject to court jurisdiction will be handled by a court of competent jurisdiction as permitted by applicable law.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect the interpretation of these Terms.

We reserve the right to update, modify, or replace portions of these Terms when reasonably necessary.

Material changes will be communicated when required by applicable law.

Your continued use of the Services following an effective change to these Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
